Supreme Court to consider workplace harassment rules

(Reuters) - The Supreme Court on Monday will hear arguments in a case that could determine when a company is liable for harassment by its employees.

The case turns on the definition of a single word - "supervisor" - under a federal civil rights law that prohibits racial, religious or sexual harassment in the workplace.

Under previous Supreme Court rulings, an employer is automatically responsible if a supervisor harasses a subordinate. The employer is not liable if the harassment is between two equal coworkers, unless it was negligent in allowing the abuse.

Since those rulings, a rift has developed between federal appeals courts over exactly who is a supervisor. On one side, three circuits say supervisors are those with the power to hire, fire, demote, promote or discipline. Three other circuits have adopted a broader standard, one that also includes employees who direct and oversee a colleague's daily work.

In the current case, Maetta Vance was the sole black catering worker at Ball State University in Muncie, Indiana. After filing numerous complaints with the university over racially charged incidents at work, she sued the university in federal court in 2006. She claimed that several white coworkers used racial epithets, references to the Ku Klux Klan and veiled physical threats against her.

In trying to hold Ball State liable, Vance's lawyers argued that one coworker, Saundra Davis, was a supervisor because she had the power to direct her day-to-day activities. Davis did not have to record her time, like other hourly employees, Vance argued. But the district court dismissed the case before a trial, finding Davis lacked sufficient authority over Vance. It also found that Ball State had taken corrective action and had not acted negligently.

The 7th U.S. Circuit Court of Appeals, in Chicago, reached the same conclusion, reasoning that Davis did not have the power to change Vance's employment status, and therefore the university was not liable for Davis's conduct.

Vance petitioned the Supreme Court.

Before deciding whether to hear the case, the Supreme Court asked the Justice Department for the government's position, as it does in some cases. U.S. Solicitor General Donald Verrilli agreed with Vance that the 7th Circuit's narrow interpretation was wrong, but also argued that this wasn't the best case to decide the issue, given what it saw as weak facts that Davis was Vance's supervisor. Vance presented no evidence of tasks or instructions Davis gave her and even said she was uncertain whether Davis was her supervisor, the government's brief said.

The Supreme Court accepted the case anyway.

Ball State has made the same argument as the government. Davis "would fail to qualify as Ms. Vance's supervisor even under the broader interpretation of that term applied by certain courts of appeals," university spokesman Tony Proudfoot said in an email, citing the Solicitor General's brief.

But Daniel Ortiz, a lawyer for Vance, said that under the broader standard there is evidence Davis was a supervisor.

Davis, who Vance believed was her supervisor, "taunted her with racial epithets, slapped her at one point and made her life a living hell," Ortiz said.

Business groups, including the U.S. Chamber of Commerce and the National Federation of Independent Business, have filed briefs supporting the narrow definition of supervisor used by the 7th, 1st and 8th Circuits.

Adopting the narrower definition allows employers to easily identify employees who would trigger automatic liability so they can be screened, trained and monitored, the business groups argue.

The open-ended definition, used by the 2nd, 4th and 9th Circuits, offers little guidance or incentive to undertake prevention efforts, the U.S. Chamber said in its brief.

Camille Olson, a lawyer at Seyfarth Shaw who represents companies, said if the Supreme Court adopts the more expansive definition, employers will be potentially liable for the conduct of a much larger pool of employees.

"The expanded definition of whose conduct binds the employer will significantly increase litigation for employers," said Olson, who is not involved in the latest case. Employees may also have less incentive to report harassment promptly and to get any immediate issues fixed, opting instead for litigation, she said.

The broad definition of supervisor would also conflict with a narrower one used in the Fair Labor Standards Act and National Labor Relations Act, creating confusion, she added.

On the other side, plaintiffs' lawyers say the stricter standard ignores the practical reality of the workplace and allows discrimination and harassment to go unpunished.

"The ones most likely to engage in harassment are the ones who deal with their coworkers day-to-day but may not have the special power to hire, fire, promote or demote," said Matthew Koski, an attorney with the National Employment Lawyers Association, a group for lawyers who represent workers.

Supervisors who make final employment decisions may be in a different office or a different state, he said.

The case is Vance v. Ball State University, U.S. Supreme Court, No. 11-556.

Commander: Iran missile technology sent to Gaza

TEHRAN, Iran (AP) ? Iran has supplied Hamas in Gaza with the technology to "quickly" produce longer-range missiles on their own without needing direct shipments, said a report Wednesday that quoted the head of Iran's powerful Revolutionary Guard.

The comments by Gen. Mohammad Ali Jafari offer some of the clearest insights on Iran's weapons support for Hamas, whose Iranian-engineered Fajr-5 missiles have struck near Tel Aviv and Jerusalem during weeklong battles with Israel.

"Gaza is under siege, so we cannot help them. The Fajr-5 missiles have not been shipped from Iran. Its technology has been transferred and (the missiles are) being produced quickly," Jafari was quoted as saying by the semiofficial ISNA news agency.

Iran has repeatedly denied it directly supplied Hamas with the Fajr-5. The ISNA report gave no further details on the level of missile know-how sent to Gaza or the channels used.

Israel charges that Iran sends weapons, including rockets, to Gaza through a network of smuggling tunnels under the 15-kilometer (9-mile) border between Gaza and Egypt.

Iran also backs the anti-Israel faction Hezbollah in Lebanon, which fired thousands of rockets into Israel during a monthlong 2006 war.

Iran's parliament speaker, Ali Larijani, meanwhile, said his country was "honored" that Iran could help Palestinians with "material and military aspects." He did not elaborate.

He criticized Arab countries for failing to help arm Hamas and other Palestinian group. "The Palestinian nation does not need speeches and meetings. Arab countries should send military aid," he was quoted as saying by the semiofficial Fars news agency.

Iran's Supreme Leader Ayatollah Khamenei also chided other Muslim nations for not rallying behind Gaza in the latest showdown with Israel.

"Some of them sufficed with words, and some others did not condemn" Israel, Khamenei said, according to the official Islamic Republic News Agency.

Israel has carried out hundreds of airstrikes in Gaza over the past week in an operation it says is meant to stop daily rocket salvos by Gaza militants at Israel.

Iran and Israel are bitter enemies, and the two nations are locked in a deepening dispute over Iran's nuclear program. The West and others fear Iran could eventually produce nuclear weapons, and Israel has left open the option of staging a military strike at its nuclear facilities.

Iran says its nuclear program is for peaceful purposes such as power generation and cancer treatment.

It has been revealed that highly successful Kickstarter project, the FORM 1 3D printer by Formlabs and, Kickstarter itself, are being sued by 3D systems, a firm long-established in the business.

The case in question revolves around patents in the stereolithography process used to cure resin with a laser/ultraviolet light.

3D printing is a new area that is moving much faster, driven by demand, into the affordable consumer domain than industry bigwigs would like to see happen, as this risks compromising sales and profit margins from long established monopolies.

3D Systems says that it is "well known" within the industry and that it had already been involved in?several?lawsuits in attempts to protect its patent rights, stating that Formlabs either must have known or chosen not to find out whether there might be a risk of patent infringement.

Opposingly, 3D Systems also stated that one of Formlab's co-founders had said one of the reasons the firm was able to offer the printer at such a low cost had been that several patents had expired "meaning that the team didn't need to pay high licensing fees to get this product to market." suggesting that Formlabs did indeed do at least some patent searching.

Should 3D Systems have a legitimate patent claim, though it seems perhaps hasty to jump into court without seemingly first attempting a settlement, there's not much Formlabs can do. What's most surprising and, perhaps further highlighting a mean-streak in the company is that it is?suing?Kickstarter for advertising the product and taking a percentage of donations.

It's not generally common practise to sue a firm that effectively advertises on-behalf of a client mandate. This writer is?beginning?to wonder if he should sue UKTV because he was?irreparably?harmed by the 'Go Compare' advertisements aired on the Dave channel, to which UKTV took payment for...

New U.S. auto sedans fall short: consumer reports

(Reuters) - The 2013 Dodge Dart is "underpowered," according to testers for Consumer Reports magazine, which also said it was "underwhelmed" by the performance of two American luxury cars, General Motors Co's 2013 Cadillac XTS and Ford Motor Co's 2013 Lincoln MKS.

The magazine, which annually tests and rates hundreds of new and used cars and trucks, said it recommended a fourth model, Toyota Motor Corp's redesigned Lexus ES sedan, although testers said the 2013 model "took a step back in ride and interior refinement from the previous ES."

The 2013 Dart sedan, which competes with such cars as the Toyota Corolla and the Ford Focus, is the first jointly developed model from Fiat SpA and its U.S. affiliate Chrysler.

Consumer Reports lauded the Dart's "solid feel, handling and ride," but said the compact sedan "can't yet measure up to the best in class."

The magazine ranked the Cadillac higher than the Lincoln, but said neither car scored well enough to earn its recommendation.

It singled out Cadillac's new CUE infotainment system as "convoluted and frustrating," while faulting the Lincoln's "cramped driving position, ungainly handling, uncomposed ride, and limited visibility."

The reviews will be in the magazine's January issue.

Documentary: Inmate may be involved in OJ case

(AP) ? A documentary about an inmate on Florida's death row says the convicted killer might have been involved in the murder of O.J. Simpson's ex-wife and her friend.

The Investigation Discovery show, "My Brother the Serial Killer," will air Wednesday.

The film is a look at Glen Rogers, who was convicted by a Florida jury in 1997 for killing a woman.

Rogers was also convicted of murder in California and is a suspect in homicides in several other states.

Rogers, who is from Hamilton, Ohio, met Nicole Brown Simpson in 1994 when he was living in Southern California, his family says in the documentary.

A criminal profiler in the film says he received paintings by Rogers with clues possibly linking him to the 1994 murders of Simpson's ex-wife and her friend, Ronald Goldman.

Simpson was accused in those killings but the so-called "trial of the century" in Los Angeles ended with his acquittal in 1995.

Simpson never testified at the criminal trial, but memorably demonstrated in court that a glove found near the slaying scene did not fit his hand. He testified at length in a wrongful death trial that led a Los Angeles civil court jury in 1997 to find him liable for damages in the case.

Much of the film is narrated by Rogers' brother, Clay Rogers, who used to rob homes with Glen Rogers as a teen but in 1993, called police on his brother after finding a body at the family's Kentucky cabin.

Clay Rogers said that in 1994, his brother told him about meeting Nicole Brown Simpson.

"They've got money, they're well off and I'm taking her down," Clay Rogers recalls Glen Rogers saying.

Other family members also said Glen Rogers talked about meeting Simpson's ex-wife.

In a statement, Goldman's sister criticized the new documentary.

"I am appalled at the level of irresponsibility demonstrated by the network and the producers of this so-called documentary," Kim Goldman said. "This is the first time we are hearing about this story, and considering that their 'main character,' Glen Rogers, confessed to stabbing my brother and Nicole to death, you would think we would be in the loop."

Simpson is currently serving a prison sentence in Nevada after being convicted in 2008 of leading five men, including two with guns, in a September 2007 confrontation with two sports memorabilia dealers and a middleman at a Las Vegas casino-hotel.
